our services. By using our website and services, placing an order, or making a
payment, you agree to be legally bound by these terms. If you disagree with
these terms, please do not use our website or services.
1. Acceptance of Terms
By placing an order, signing up, or using our services in any way, you:
- Agree to comply with these Terms and Conditions.
- Confirm that you are of legal age in your jurisdiction.
- Acknowledge that this Agreement constitutes the full understanding between
you and
Publishing Avenue.
You may only use this Website and our Services if you are of legal age in your
jurisdiction.
Misuse or misrepresentation of identity, age, or purpose violates this
Agreement.
2. Definitions
- Website: Refers to www.publishingavenue.com.
- Company, We, Us, Our: Refers to Publishing Avenue.
- Client, You, Your, Customer: Refers to the individual or
business placing
an order or using our services.
- Order: Any formal request to receive services or products
from Publishing
Avenue.
- Product/Service: Any deliverables provided by Publishing
Avenue, including
but not limited to written content, publishing assistance, illustrations,
marketing, or
design work.
3. Order Process & Delivery
- Orders can be placed via our website, email, or phone.
- The project officially begins upon receipt of payment.
- All timelines start after the client submits the full brief and materials.
- Any scope change may affect deadlines and pricing.
4. Refund Policy
4.1 Change of Mind
- 100% refund if the request is made within 24 hours and work has not started.
- After 24 hours, refunds are subject to service and transaction fee
deductions.
4.2 Non-Compliance with Requirements
- Unlimited revisions are available within the original scope.
- A partial refund may be issued upon mutual agreement if we fail to meet
project expectations
even after multiple revisions.
4.3 Missed Delivery Deadlines
- Refunds for delays apply only if:
- The client made three documented follow-ups, and
- The delay was the Company's fault.
4.4 Refund Timeframe
Requests must be made within 10 days of final delivery. No exceptions after this
window.
4.5 Non-Refundable Cases
Refunds will not be granted for:
- Minor issues (typos, formatting, missing references).
- Changes in personal preference not aligned with the original brief.
- Orders placed for unethical purposes (e.g., academic dishonesty).
- Projects abandoned with no client communication for 20+ days.
5. Revisions and Edits
- Revisions are available for all projects based on the original scope.
- Changes that exceed the original scope may incur additional charges.
- After 10 days of client silence post-delivery, the project will be marked as
finalized.
6. Project Abandonment & Reactivation
- Inactivity or no communication for 20+ consecutive days results in automatic
closure.
- A reopening fee may be required to reactivate your account, depending on the
scope and time
since closure.
- No refunds are offered for abandoned projects.
7. Project Completion & Claims
- Projects will be closed if no revisions or complaints are submitted within
10 days of final
delivery.
- No disputes or claims will be entertained beyond this window.
8. Copyright & Ownership
- Upon full payment, the client receives full copyright ownership of the
deliverables.
- We do not reuse or resell original work.
- Unless covered by an NDA, our portfolio may use anonymized samples.
9. Legal & Ethical Use
- Clients are responsible for the ethical use of all materials.
- We strictly prohibit plagiarism, academic fraud, or any illegal use of
content.
- Clients agree to indemnify us from any legal or academic consequences of
misuse.
10. Plagiarism & Authenticity
- All content is 100% original.
- No AI-generated content is used unless requested.
- Plagiarism reports are available upon request.
11. Image Usage & Media Policy
- We do not own third-party stock images. Suggested media must be
verified/licensed by the
client.
- In-house photos are copyright-free unless restricted by custom agreement.
- Clients are solely responsible for the lawful usage of all visuals.
12. Third-Party Tools & Services
- We may use third-party platforms for design, communication, and payments.
- When using our services, you also agree to those providers' terms and
privacy policies.
13. Service Fees on Refunds
- Even eligible refunds are subject to non-refundable service and processing
charges (e.g.,
merchant gateway, admin fees).
- A full 100% refund is not guaranteed unless explicitly stated.
14. Client Responsibility Post-Delivery
- Once content is delivered, the client assumes full responsibility for using,
sharing, or
distributing it.
- We are not liable for:
- Defamation
- Academic penalties
- Legal actions stemming from misuse
15. Limitation of Liability
- We are not liable for:
- Indirect, incidental, or consequential damages
- Delays caused by client-side issues or technical disruptions
- Certain jurisdictions may limit this exclusion. Check your local laws.
16. Modifications to Terms
- We may revise these Terms at any time.
- Updated terms will be posted with a new “Last Updated” date.
- Continued use after updates constitutes acceptance.
17. Governing Law & Jurisdiction
- The laws of the State of Florida, USA, govern this Agreement.
- All legal disputes shall fall under the exclusive jurisdiction of the courts
in Orlando, Florida.
Publishing Agreement
This Publishing Agreement ("Agreement") is made between Publishing Avenue ("Publisher") and the client
("Author" or "Customer") for the provision of publishing services. The following
terms and conditions govern this engagement:
1. Scope of Services
Publishing Avenue agrees to provide publishing
services as agreed upon in the project scope, including but not limited to
editing, formatting, design, ISBN registration, and distribution support.
2. Author's Responsibility
The Author shall provide all required content, text, images, artwork, or other
materials (collectively referred to as "Materials") for publication.
The Author confirms that all Materials submitted:
- Are original or legally obtained with appropriate rights and permissions.
- Do not infringe upon any copyright, trademark, privacy, publicity, or other
legal rights of any third party.
- Are not forged, plagiarized, or unlawfully copied from any source.
3. Copyright and Ownership
The Author retains full copyright ownershipof their Materials.
The Author grants Publishing Avenue a
non-exclusive license to use, reproduce, and distribute the Materials solely for
the purpose of fulfilling this agreement.
4. Indemnification
The Author agrees to indemnify, defend, and hold harmless Publishing Avenue and its employees, agents, and
affiliates from and against any claims, losses, or damages (including legal
fees) arising out of:
- Allegations of copyright infringement or violation of third-party rights.
- Inaccurate, false, or defamatory content provided by the Author.
5. Limitation of Liability
Publishing Avenue does not accept
responsibility or liability for:
- Leaks, unauthorized distribution, or access to any content or Materials once
provided by the Author.
- Loss or damage arising from data breaches, theft, or misuse outside the
reasonable control of the Publisher.
6. Confidentiality
While Publishing Avenue takes standard industry
precautions to maintain the confidentiality of submitted content, absolute
security cannot be guaranteed.
The Author agrees to submit only finalized, non-sensitive content for publishing
purposes.
7. Termination
Either party may terminate this agreement with written notice. Upon termination,
Publishing Avenue will return all submitted
content and cease any further distribution or processing, unless otherwise
agreed in writing.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of
the State of Pennsylvania.
This document represents the complete agreement between the parties.
